Professional Indemnity

What you’re covered for

Negligence
If you do not use reasonable care and skill, or make a negligent misstatement or misrepresentation.

Breach of contract
If you unintentionally breach a contract, hold harmless or indemnity agreement.

Defamation, libel & slander
Unknowingly damaging the reputation of any person or organisation, including mental anguish or emotional distress.

Violating right of privacy or publicity
Accidentally invading a right of privacy, including using someone’s name, persona, voice or likeness.

Infringement of Intellectual Property
Unintentional infringement of intellectual property such as copyright, trade mark, including plagiarism.

Any other civil liability
Any act or omission that causes a civil liability that’s not excluded in your term and conditions.

Previous work
If you have been insured previously, we will match your retroactive date for free. Simply login to your account and update your retroactive date.

Claims expenses
You are covered for all costs and expenses for defending you against an allegation, even if the allegation turns out to be false.

What you’re not covered for

Work in the USA or Canada
Any work that you do for companies in the USA or Canada, or work that is under contract where claims can be brought against you in US or Canadian courts.

What you’re covered for

Tax protection
Our tax advisors and accountants will represent your business if a dispute arises following a compliance check by HMRC. They will also deal with HMRC if there is an enquiry into your business, as well as a range of appeals.

Legal defence
All business must operate within a complicated frame-work of legislation. We will pay the legal costs of defending your business from criminal prosecutions, including motoring offences.

Crisis communication
We will pay up to £10,000 in professional fees to provide expert advice to help you manage communication effectively in times of crisis. This can include drafting a media statement as well as preparing suitable communications for your staff and customers or suppliers.

Compliance & regulation
We will appeal against statutory notices issued against you or defend your business against any civil action brought under the Data Protection Act. We can also help if your business is investigated by a regulatory body of if you have to attend a professional or regulatory disciplinary hearing.

Contract & debt recovery
Problems with cash flow are very common and making sure your customers pay promptly is essential. If you have a late payment issue, we will negotiate to resolve the situation as quickly as possible.

What you’re not covered for

Misstatements, fraud investigations or tax avoidance
We will not cover any claim which contains careless or deliberate misstatements or have not met legal timescales; any investigation by the Fraud Investigation Service of HM Revenue and Customs or any accusations of tax avoidance.

Parking offences
We do not pay for legal defence for any parking offences.

Actions other than appeals, or Health & Safety fees
For any compliance or regulation claim, we will not pay to pursue an action other than an appeal, nor a Health and Safety Fee for Intervention.

Breach of professional duty or arbitration or adjudication
We will not chase invoices, or seek to recover a debt where there has been a breach of professional duty. We also do not cover the costs of arbitration or adjudication.

Public Liability

What you’re covered for

Third party Injury and Damage
Accidentally causing injury to someone, such as a client or visitor, (for instance, someone tripping over your bag) or damage to someone’s property (such as spilling coffee over someone’s laptop).

Criminal Defence Costs (up to £100,000)
If a criminal case is brought against you, you are covered for legal costs up to £100,000.

Court attendance compensation (up to £250 per day)
If you need to attend court as a witness to a criminal case brought against you.

Business Equipment

What you’re covered for

Loss or Damage
Accidental loss, theft or damage of equipment that’s owned by your business.

New for old
We will replace your equipment with a new or refurbished version; or cash equivalent.

Worldwide
Your equipment is covered worldwide.

What you’re not covered for

Unattended equipment theft
You are not insured if you leave your equipment in a public place (such as a café) and it is lost or stolen; however you are covered for theft from a shared work space which requires entry through a sign-in process.

Data breach
Theft, loss or disclosure of someone’s personally identifiable information or a company’s corporate information

Computer Security Failure
Failure in your computer security resulting in loss or alteration of your data, or means your computer is used to transmit malicious code, such as a virus or trojan horse or is used in a Denial of Service Attack

Legal and Forensic Services
To determine the cause of any electronic breach

Notified individuals
To notify individuals who’s data has been affected and who you are required to notify under a Breach Notice Law

Credit monitoring services
To monitor the credit of individuals who’s data was compromised or there is a reasonable belief that they were compromised

Identity monitoring services
To monitor the identity of individuals who’s data was compromised or there is a reasonable belief that they were compromised

Failure to disclose a Data Breach or Computer Security Failure
Failure to notify the relevant authorities as required by law if you suffer either of the above

Regulatory Defence and Penalties up to £10,000
Costs from violating a privacy law that covers any of the three above

Privacy Policy Failure
Your failure to keep to a privacy policy that states that you look after someone’s personally identifiable information, provide access to it, or to correct the information if it is incomplete or inaccurate
